TheNorthDakotaSupremeCourtheardargumentsonwhetheralowercourtrulingblockingthestate’sabortionbanshouldremain.
DistrictJudgeBruceRomanicksaidthelawpassedinthe2023Legislature—whichprohibitsabortion,exceptforthelifeofthewomanorcasesofrapeorincest,limitedtothefirstsixweeksofpregnancy–wastoovague,andgoesagainstthestate’sConstitution.RomanickruledtheConstitutionprotectsawoman’srightto“pro-creative”autonomy,whichwouldincludetherighttoseekanabortionbeforethefetusisviable.
Thestateappealedthatdecision.
“NothinginourhistorysuggestsourConstitutionhaseverbeenunderstoodtoguaranteeabortionsunrelatedtothemother’slifeorhealth,”AssistantNorthDakotaAttorneyGeneralPhilAxttoldtheCourt.“TheywereillegalinthisstatebeforetheConstitutionwasadopted,whenitwasadopted,andfornearlyacenturyafterwards,untilRoe.Andit’snotlikethoselawswereunknownorunenforced.Peoplewereprosecutedunderthem.AndtheDistrictCourtd
